On June 20, 2025, the Colorado District Court for Pitkin County granted CSV client Hillary Thomas’s motion for sanctions against Genstar Capital chairman and managing partner Jean-Pierre Conte and his counsel at Glaser Weil Fink Howard Avchen & Shapiro LLP. Ms. Thomas sought sanctions for the improper redaction of the notes from a joint couples therapy session involving herself and Mr. Conte that occurred in the immediate aftermath of the violent physical attack Ms. Thomas alleges in her lawsuit.
On December 17, 2024, a special discovery master appointed by the court ordered Mr. Conte to produce the unredacted notes from the couple’s therapy sessions (the special master permitted Mr. Conte to preserve the confidentiality of the notes from his individual therapy). However, Mr. Conte’s subsequent production improperly concealed behind redactions the notes from a session that occurred less than two weeks after the events at issue in the case. This concealment, which included obscuring a reference to “physical abuse,” was revealed during the February 5, 2025 deposition of Ms. Thomas and Mr. Conte’s joint therapist. Ms. Thomas promptly sought sanctions for the violation of the special master’s order. In the Order, the court awarded Ms. Thomas fees and costs associated with the discovery dispute related to the notes and deposition.
