In a win for Clark Smith Villazor’s client AllianceBernstein, a New York state appellate court, on February 1, 2024, held that the global investment firm was properly dismissed from a lawsuit seeking to hold the firm liable after individuals who used a co-working business center run by AllianceBernstein’s subtenant supposedly breached a contract with the plaintiffs and sought to defraud them. The New York Appellate Division, First Department, agreed with CSV’s argument that AllianceBernstein had no duty to control the alleged fraudsters’ conduct and no duty to investigate the individuals using the co-working center. CSV’s Brian Burns briefed and argued the appeal on behalf of AllianceBernstein.
